  1. YOU SHOULD CAREFULLY READ THE FOLLOWING END USER LICENSE AGREEMENT 
  2. BEFORE INSTALLING THIS SOFTWARE PROGRAM. BY INSTALLING, COPYING, OR 
  3. OTHERWISE USING THE SOFTWARE PROGRAM, YOU AGREE TO BE BOUND BY THE 
  4. TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS 
  5. AGREEMENT, PROMPTLY RETURN THE UNUSED SOFTWARE PROGRAM TO THE PLACE 
  6. FROM WHICH YOU OBTAINED IT FOR A FULL REFUND.

  8. This software program (the "Program"), any printed materials, any on-
  9. line or electronic documentation, and any and all copies and 
  10. derivative works of such software program and materials are the 
  11. copyrighted work of Blizzard Entertainment, a division of Davidson & 
  12. Associates, Inc., or its suppliers. All use of the Program is governed 
  13. by the terms of the End User License Agreement which is provided below 
  14. ("License Agreement"). The Program is solely for use by end users 
  15. according to the terms of the License Agreement. Any use, reproduction 
  16. or redistribution of the Program not in accordance with the terms of 
  17. the License Agreement is expressly prohibited.

  20. END USER LICENSE AGREEMENT
  21.  
  22.    1. Limited Use License. Blizzard Entertainment ("Blizzard") hereby 
  23. grants, and by installing the Program you thereby accept, a limited, 
  24. non-exclusive license and right to install and use one (1) copy of the 
  25. Program for your use on either a home or portable computer. In 
  26. addition, the Program has a multi-player capability that allows up to 
  27. eight players per registered version of the Program to play 
  28. concurrently. These additional copies of the Program are known as and 
  29. referred to hereafter as "Spawned Versions." You may install Spawned 
  30. Versions of the Program on an unlimited number of computers. However, 
  31. Spawned Versions of the Program must be played in conjunction with the 
  32. registered version of the Program from which they were spawned. All of 
  33. the terms and conditions of the License Agreement shall also apply to 
  34. the Spawned Version of the Program, with the exception that the 
  35. Spawned Version Program may be installed on as many computers as you 
  36. wish. The Program also contains a Level Editor (the "Editor") that 
  37. allows you to create custom levels or other materials for your 
  38. personal use in connection with the Program ("New Materials"). All use 
  39. of the Editor or any New Materials is subject to this License 
  40. Agreement. The Program is licensed, not sold. Your license confers no 
  41. title or ownership in the Program.

  43.    2. Ownership. All title, ownership rights and intellectual property 
  44. rights in and to the Program and any and all copies thereof (including 
  45. but not limited to any titles, computer code, themes, objects, 
  46. characters, character names, stories, dialog, catch phrases, 
  47. locations, concepts, artwork, animations, sounds, musical 
  48. compositions, audio-visual effects, methods of operation, moral 
  49. rights, any related documentation, and "applets" incorporated into the 
  50. Program) are owned by Blizzard Entertainment or its licensors. The 
  51. Program is protected by the copyright laws of the United States, 
  52. international copyright treaties and conventions and other laws. All 
  53. rights are reserved. The Program contains certain licensed materials 
  54. and Blizzard's licensors may protect their rights in the event of any 
  55. violation of this Agreement.

  57.    3. Responsibilities of End User.
  58.  
  59.       A. Subject to the Grant of License hereinabove, you may not, in 
  60. whole or in part, copy, photocopy, reproduce, translate, reverse 
  61. engineer, derive source code, modify, disassemble, decompile, create 
  62. derivative works based on the Program, or remove any proprietary 
  63. notices or labels on the Program without the prior consent, in 
  64. writing, of Blizzard.

  66.       B. The Program is licensed to you as a single product. Its 
  67. component parts may not be separated for use on more than one 
  68. computer. 
  69.  
  70.       C. You are entitled to use the Program for your own use, but you 
  71. are not be entitled to:
  72.  
  73.     (i) sell, grant a security interest in or transfer
  74.     reproductions of the Program to other parties in any way, nor 
  75.     to rent, lease or license the Program to others without the 
  76.     prior written consent of Blizzard.
  77.  
  78.     (ii) exploit the Program or any of its parts for any 
  79.     commercial purpose including, but not limited to, use at a 
  80.     cyber cafΘ, computer gaming center or any other location-
  81.     based site. Blizzard may offer a separate Site License 
  82.     Agreement to permit you to make the Program available for 
  83.     commercial use; contact Blizzard for details;
  84.  
  85.     (iii) use or allow third parties to use the Editor and the 
  86.     New Materials created thereby for commercial purposes 
  87.     including, but not limited to, distribution of New Materials 
  88.     on a stand alone basis or packaged with other software or 
  89.     hardware through any and all distribution channels, 
  90.     including, but not limited to, retail sales and on-line 
  91.     electronic distribution without the express written consent 
  92.     of Blizzard; and
  93.  
  94.     (iv) host or provide matchmaking services for the Program or 
  95.     emulate or redirect the communication protocols used by 
  96.     Blizzard in the network feature of the Program, through 
  97.     protocol emulation, tunneling, modifying or adding components 
  98.     to the Program, use of a utility program or any other 
  99.     techniques now known or hereafter developed, for any purpose 
  100.     including, but not limited to network play over the Internet, 
  101.     network play utilizing commercial or non-commercial gaming 
  102.     networks or as part of content aggregation networks without 
  103.     the prior written consent of Blizzard.

  105.    4. Program Transfer. You may permanently transfer all of your 
  106. rights under this License Agreement, provided the recipient agrees to 
  107. the terms of this License Agreement and you agree to remove the 
  108. Program and any New Materials from your home or portable computer.
  109.  
  110.    5. Termination. This License Agreement is effective until 
  111. terminated. You may terminate the License Agreement at any time by 
  112. destroying the Program and any New Materials. Blizzard may, at its 
  113. discretion, terminate this License Agreement in the event that you 
  114. fail to comply with the terms and conditions contained herein. In such 
  115. event, you must immediately destroy the Program and any New Materials.

  117.    6. Export Controls. The Program may not be re-exported, downloaded 
  118. or otherwise exported into (or to a national or resident of) any 
  119. country to which the U.S. has embargoed goods, or to anyone on the 
  120. U.S. Treasury Department's list of Specially Designated Nationals or 
  121. the U.S. Commerce Department's Table of Denial Orders. By installing 
  122. the Program, you are agreeing to the foregoing and you are 
  123. representing and warranting that you are not located in, under the 
  124. control of, or a national or resident of any such country or on any 
  125. such list.

  127.    7. Limited Warranty. Blizzard expressly disclaims any warranty for 
  128. the Program, Editor and Manual(s). The Program, Editor and Manual(s) 
  129. are provided "as is" without warranty of any kind, either express or 
  130. implied, including, without limitation, the implied warranties of 
  131. merchantability, fitness for a particular purpose, or noninfringement. 
  132. The entire risk arising out of use or performance of the Program and 
  133. Manual(s) remains with the User, however Blizzard warrants up to and 
  134. including 90 days from the date of your purchase of the Program that 
  135. the media containing the Program shall be free from defects in 
  136. material and workmanship. In the event that the media proves to be 
  137. defective during that time period, and upon presentation to Blizzard 
  138. of proof of purchase of the defective Program, Blizzard will at its 
  139. option 1) correct any defect, 2) provide you with a product of equal 
  140. or lesser value, or 3) refund your money. Some states do not allow the 
  141. exclusion or limitation of implied warranties or liability for 
  142. incidental damages, so the above limitations may not apply to you.

  144.    8. Limitation of Liability. NEITHER BLIZZARD, DAVIDSON & 
  145. ASSOCIATES, INC., ITS PARENT, SUBSIDIARIES OR AFFILIATES SHALL BE 
  146. LIABLE IN ANY WAY FOR LOSS OR DAMAGE OF ANY KIND RESULTING FROM THE 
  147. USE OF THE PROGRAM OR EDITOR INCLUDING, BUT NOT LIMITED TO, LOSS OF 
  148. GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND 
  149. ALL OTHER COMMERCIAL DAMAGES OR LOSSES.

  151.    9. Equitable Remedies. You hereby agree that Blizzard would be 
  152. irreparably damaged if the terms of this License Agreement were not 
  153. specifically enforced, and therefore you agree that Blizzard shall be 
  154. entitled, without bond, other security, or proof of damages, to 
  155. appropriate equitable remedies with respect to breaches of this 
  156. License Agreement, in addition to such other remedies as Blizzard may 
  157. otherwise have available to it under applicable laws.

  159.    10. Miscellaneous. This License Agreement shall be deemed to have 
  160. been made and executed in the State of California and any dispute 
  161. arising hereunder shall be resolved in accordance with the law of 
  162. California. You agree that any claim asserted in any legal proceeding 
  163. by one of the parities against the other shall be commenced and 
  164. maintained in any state or federal court located in the State of 
  165. California, County of Los Angeles, having subject matter jurisdiction 
  166. with respect to the dispute between the parties. This License 
  167. Agreement may be amended, altered or modified only by an instrument in 
  168. writing, specifying such amendment, alteration or modification, 
  169. executed by both parties. In the event that any provision of this 
  170. License Agreement shall be held by a court or other tribunal of 
  171. competent jurisdiction to be unenforceable, such provision will be 
  172. enforced to the maximum extent permissible and the remaining portions 
  173. of this License Agreement shall remain in full force and effect. This 
  174. License Agreement constitutes and contains the entire agreement 
  175. between the parties with respect to the subject matter hereof and 
  176. supersedes any prior oral or written agreements.

  178. I hereby acknowledge that I have read and understand the foregoing 
  179. License Agreement and agree that the action of installing the Program 
  180. is an acknowledgment of my agreement to be bound by the terms and 
  181. conditions of the License Agreement contained herein. I also 
  182. acknowledge and agree that this License Agreement is the complete and 
  183. exclusive statement of the agreement between Blizzard and I and that 
  184. the License Agreement supersedes any prior or contemporaneous 
  185. agreement, either oral or written, and any other communications 
  186. between Blizzard and myself.
